A Wisconsin OWI is described in Wisconsin DUI statute 346.63 Operating Under the Influence of intoxicant or other drug. It states that no person may drive or operate a motor vehicle while under the influence of an intoxicant, a controlled substance or any combination of the 2 to a degree which renders him or her incapable of safely driving.
